The law is on your side

India has a law that protects people with mental illness. It is the Mental Healthcare Act, 2017. Many families call it the MHCA.

This law gives your loved one real rights. It also gives you, the family, a real place in their care.

The law is written in heavy language. This guide puts the main rights in plain words, so you know what to expect and what to ask for.

The right to dignity

Your loved one has the right to be treated with dignity. Not as an inmate. Not as a problem to be locked away.

They must be safe from cruelty and harm. They must be spoken to and cared for with respect.

This is why we call the people in our care residents, and why care must always protect their dignity.

The right to the least restrictive care

The law says care should use the least restriction possible. Freedom is taken away only as much as safety truly requires, and no more.

This is honest, not absolute. During an acute episode, some restriction may be needed to keep a person and others safe. The law allows this, within strict limits, and always with dignity.

A good home follows this closely. It does not restrain for convenience. It uses the gentlest care that keeps everyone safe, and stabilises hard episodes through proper medical care.

The right to information

You and your loved one have the right to know what is happening. What the illness is. What the treatment is. What the choices are.

You should not be kept in the dark. If something is unclear, you are allowed to ask until you understand.

The right to have family involved

The law values family. In many cases a family member can act as a nominated representative, someone who helps make decisions in the person’s best interest.

This means you are not pushed aside when your loved one enters care. You stay involved. You are consulted. Your voice counts. TODO(asset): plain note on how to be named as a nominated representative.

Protection from cruelty and neglect

Your loved one has the right to be safe. Safe from abuse. Safe from neglect. Safe from being tied down or shut away without cause.

If a place ever treats a resident with cruelty, that is against the law. You have every right to speak up and act.

What this means when choosing a home

A home that respects the law will be open about all of this. It will show its registration. It will explain how it protects dignity and uses the least restriction possible.
